1. scope of application
The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity.

2 Contracting party, conclusion of contract, correction options
2.1 The purchase contract is concluded with Lea Heidkamp Yannic Heidkamp Oswin Soritz GbR, Butter and Lamp.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order you will receive another confirmation by e-mail. 
2.2 The services of the seller include in particular the sale of candles made of beeswax. In this regard, it should be noted that beeswax varies in its properties (especially fragrance and colour) depending on the batch. These handicraft items, which are manufactured as individual pieces or in small series, may differ in shape and colour. There may also be deviations from the published photographs. Such deviations - also size deviations of some millimeters, with wax sticks also some centimeters - are caused by the handicraft processing and represent by common consent no lack. Also, small errors due to storage, printing or shipping cannot be claimed by the contractual partner. 
2.3 The seller is not liable for the improper use of candles and refers to the following safety precautions, which must be observed:
a) Candles burn as open fire, especially beeswax candles need some care and should never be used without supervision.
b) Flammable objects must never be in the danger zone of the candle. The candle may only be used in appropriate holders or on sufficiently large fire-proof supports which catch the wax in the event of the candle running. The protection of the base must be ensured.
(c) candles shall be kept out of reach of children.
d) The aggregate state of beeswax candles changes according to temperature. When cold, beeswax is brittle and hard. Handle the candle with special care to avoid breakage. Protect the candle from direct sunlight. Do not store or use the candles near heat sources.
(e) Natural beeswax is used in the manufacture of the candles. Pollen residues or other impurities can lead to the formation of soot lumps. Such soot lumps must be removed to ensure that the candle burns well.
f) Do not use candles outdoors or in draughts.
The seller is not liable for the improper use and functionality of the candlesticks and wax stick holders.

We save the text of the contract and send you the order data and our GTC in text form. The contract text is no longer accessible via the Internet for security reasons.

4. delivery conditions
Shipping costs will be added to the indicated product prices. You can find out more about the amount of the shipping costs at the offers.
In principle, you have the option of collection from: Butter and Lamp, Bergisch Gladbacher Str. 1085, House No. 20, Room 20.8, 51069 Cologne, Germany during the following business hours: Mon-Fri: 10:00 a.m. to 4:00 p.m.
We do not deliver to packing stations.

5. payment
In our shop you can choose between the following payment methods:
PayPal
In the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is automatically carried out by PayPal after the goods have been dispatched. You will receive further instructions during the ordering process.
Payment processing through PayPal Services
In cooperation with the payment service PayPal we offer various payment methods as PayPal Services. In order to pay the invoice amount, you do not have to be registered with PayPal. Depending on the selected payment method, you may be redirected to the PayPal website and the selected payment service after submitting your order.
Credit card: The payment transaction is carried out immediately after confirmation of the payment instruction and after your legitimation as a legitimate cardholder by your credit card company at the request of PayPal and your card is charged. Giropay: On PayPal's website, you can enter your payment details and confirm PayPal's use of your details. You will then be redirected to the website of Giropay GmbH. In order to be able to pay the invoice amount via Giropay, you must have a bank account that is activated for online banking, identify yourself accordingly and confirm the payment instruction. The payment transaction will be carried out immediately afterwards and your account will be debited.
Direct debit: On PayPal's website, you can enter your payment details, confirm PayPal's use of your details and confirm the payment instruction to PayPal. With confirmation of the payment instruction you give PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). By submitting the direct debit mandate immediately after confirming the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited. 
Sofort by klarna: On PayPal's website, you can enter your payment details and confirm PayPal's use of your data. You will then be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that is activated for online banking, identify yourself accordingly and confirm the payment instruction. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.You will receive further instructions during the ordering process.

6. retention of title 
The goods remain our property until full payment has been made.

7. transport damage 
If goods are delivered with obvious transport damage, please complain about such defects to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

8 Warranty and guarantees 
Unless otherwise expressly agreed below, the statutory liability for defects shall apply. The following applies to used goods: if the defect occurs after the expiry of one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods. 
The aforementioned restrictions and shortening of time limits shall not apply
- for claims based on damage caused by us, our legal representatives or vicarious agents 
- in case of injury to life, body or health 
- in case of intentional or grossly negligent breach of duty as well as fraudulent intent
- in the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
- within the scope of a guarantee promise, as far as agreed or 
- insofar as the scope of application of the Product Liability Act is opened.
Information on any applicable additional guarantees and their exact conditions can be found in each case with the product and on special information pages in the online shop.

9. liability 
For claims based on damages caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation
- in case of injury to life, body or health
- in case of intentional or grossly negligent breach of duty
- in the case of warranty promises, insofar as agreed, or
- insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of material contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
